1. Acceptance of Terms

By downloading, installing, or using the Moves mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and The Moves App, L.L.C. ("Company," "we," "us," or "our").

2. Eligibility

To use Moves, you must:

• Be at least 21 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. User Conduct

When using Moves, you agree NOT to:

• Post false, misleading, or fraudulent content
• Harass, bully, or intimidate other users
• Post content that is obscene, hateful, or discriminatory
• Impersonate any person or entity
• Use the App for illegal purposes
• Attempt to gain unauthorized access to any systems
• Interfere with other users' enjoyment of the App
• Post spam, advertisements, or promotional content
• Collect or harvest user data without permission
• Use automated systems or bots to access the App

5. User-Generated Content

You may submit content including ratings, reviews, photos, and check-ins ("User Content"). By submitting User Content, you:

• Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content
• Represent that you own or have rights to the content
• Understand that User Content may be visible to other users
• Accept that we may remove content that violates these Terms

We reserve the right to moderate, remove, or refuse to display any User Content at our sole discretion.

6. Location Services

Moves uses location services to provide venue-related features. By enabling location access, you:

• Consent to the collection of your location data
• Understand that check-ins record your location at specific venues
• Can disable location services at any time in your device settings

7. Intellectual Property

The App and its original content, features, and functionality are owned by The Moves App, L.L.C. and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our App or included software without our express written permission.

8. Third-Party Services

The App may contain links to or integrate with third-party services. We are not responsible for:

• The content or practices of third-party services
• Any damage or loss caused by third-party services
• The accuracy of venue information from third-party sources

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will be uninterrupted or error-free
• Venue information is accurate or up-to-date
• The App will meet your specific requirements
• Any defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE MOVES APP, L.L.C. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Any damages arising from your use of the App

11. Indemnification

You agree to indemnify and hold harmless The Moves App, L.L.C., its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

12. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason including:

• Violation of these Terms
• Fraudulent or illegal activity
• Conduct harmful to other users or the App

Upon termination, your right to use the App will cease immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date and, where appropriate, through in-app notifications.

Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
